Terms of Service

These Terms govern use of SiteVisit by organization customers, their authorized portal users, visitors checking into sites, and verified workers whose visits may be shared through an approved SiteVisit partnership. SiteVisit is a site-access, communication and recordkeeping platform. It is not an emergency service and does not replace a site's safety program, emergency procedures or professional judgment.

1. Agreement to these Terms

By accessing or using sitevisit.ca, the SiteVisit client portal, visitor application, QR or digital check-in experience, welfare features, notifications, or related services (collectively, the “Service”), you agree to these Terms and acknowledge the Privacy Policy. If you use the Service for an organization, you represent that you are authorized to act for that organization.

A location may also present site-specific terms, policies or acknowledgements. Those requirements supplement these Terms. If an organization and SiteVisit enter into a separate written agreement, that agreement controls to the extent of a direct conflict.

2. Who uses SiteVisit

For these Terms:

  • Organization Customer means an organization that creates or uses a SiteVisit organization account.
  • Authorized User means an owner, administrator, manager, supervisor, location contact or other person given portal access by an Organization Customer.
  • Visitor means a person using SiteVisit to enter, remain at or check out of a location.
  • Host Organization means the organization responsible for the location being visited.
  • Home Organization means a SiteVisit organization with which a Visitor has a verified staff affiliation.

3. The Service

SiteVisit may provide QR-based or digital site check-in, phone verification, visitor profiles, visit records, optional point-in-time GPS proximity verification, site terms, site logs, approved site information, problem reporting, notifications, welfare follow-up, partner visibility, reporting and organization administration.

Features are configurable and may differ by organization or location. A feature appearing in SiteVisit does not mean that every location uses or monitors that feature.

4. Site access and site rules

SiteVisit records and supports a site's access process; it does not itself grant physical access to a property. The Host Organization remains responsible for deciding who may enter, establishing site rules, maintaining required safety procedures, providing appropriate supervision and complying with applicable law.

A successful QR scan, phone verification, GPS verification, staff-affiliation check or SiteVisit check-in is not a representation that a Visitor is trained, qualified, authorized by law, safe to perform work, or free from hazards.

5. Accounts, identity and accurate information

You must provide accurate information and keep account, profile, contact and site information reasonably current. You may not impersonate another person, misrepresent an organization affiliation, share portal credentials improperly, or attempt to create a misleading visit record.

Organization Customers are responsible for controlling their Authorized Users, assigning appropriate roles and location access, promptly disabling access that is no longer required, and protecting account credentials.

6. Phone, email, push and voice communications

The Service may send operational communications needed to provide SiteVisit, including verification codes, check-in or checkout notices, welfare messages, automated voice calls, problem-report notices, partner notifications, security messages and push notifications. Standard carrier, messaging or data charges may apply.

Some communications are necessary for requested features. Disabling or blocking them may prevent verification, welfare follow-up or other parts of the Service from functioning.

7. GPS verification

When a Host Organization enables GPS verification, SiteVisit may ask a Visitor's device for its current location to determine whether the device is within the configured distance of the site. This is intended as a point-in-time proximity check. SiteVisit is not designed to continuously track a Visitor's movements.

GPS, browser location and network-based positioning can be delayed, unavailable or inaccurate. A GPS result must not be used as the sole basis for emergency response, worker rescue, proof of exact physical position, or any other use requiring precise real-time location.

8. Welfare monitoring and escalations

SiteVisit is not an emergency service. Welfare checks, SMS messages, automated calls, push notifications and escalations can be delayed, blocked, misdirected or unavailable because of device settings, carrier conditions, third-party outages, incorrect contact information, loss of connectivity or other causes.

If welfare monitoring is enabled, SiteVisit may schedule automated prompts, record responses or lack of response, place automated calls, and notify configured contacts or approved partner organizations. These tools are intended to assist an organization's existing safety process, not replace it.

Organization Customers are responsible for configuring appropriate contacts and escalation settings, keeping them current, training personnel on their meaning, and maintaining independent emergency procedures. Visitors must follow site emergency procedures and contact emergency services directly when immediate help is required.

9. Site Assistant and automated classification

Some features use artificial intelligence. The Site Assistant is designed to answer from site knowledge supplied by the Host Organization. Problem reports may also be automatically summarized or categorized.

AI-generated output may be incomplete, inaccurate or misunderstood. It is informational only and must not be treated as a substitute for site signage, instructions from qualified personnel, emergency procedures, legal advice, engineering advice, medical advice or professional safety judgment. If information conflicts, follow the Host Organization's authoritative procedures and personnel.

Organization Customers are responsible for the accuracy, appropriateness and currency of site knowledge, instructions and other content they provide to the Service.

10. Partner organizations

Where two organizations have an approved SiteVisit partnership and a Visitor has a verified staff affiliation, SiteVisit may make visit and safety-event information visible to both the Host Organization and the Visitor's Home Organization, as configured in the Service.

Organization Customers are responsible for ensuring that they have appropriate authority to create partnerships, verify staff affiliations and receive or disclose information through the partnership features.

11. Problem reports, photos and other content

You retain ownership of content you submit to SiteVisit. You grant SiteVisit a non-exclusive licence to host, process, transmit, reproduce and otherwise use that content as reasonably necessary to operate, secure and support the Service.

Do not upload information or images that are unlawful, malicious, unrelated to legitimate site operations, or unnecessarily sensitive. Problem-report photos may be processed and transmitted to the recipients configured by the Host Organization.

12. Organization Customer responsibilities

Each Organization Customer is responsible for its use of the Service, including:

  • providing accurate location, contact, safety and site-knowledge information;
  • deciding which access, notification, welfare, partner and GPS features are appropriate;
  • obtaining any notices, consents or legal authority required for its workers, visitors and contacts;
  • maintaining its own safety management, emergency response and regulatory compliance programs;
  • reviewing and responding to alerts, reports and records as appropriate; and
  • using personal information obtained through SiteVisit only for lawful, legitimate purposes.

13. Acceptable use

You may not use the Service to:

  • gain unauthorized access to accounts, systems, locations or information;
  • interfere with, probe, overload, bypass or defeat security or access controls;
  • submit false check-ins, false emergencies, fraudulent reports or deceptive identity information;
  • harass, threaten, unlawfully monitor or discriminate against another person;
  • send unlawful spam or use SiteVisit communications for unrelated marketing;
  • upload malware or content that infringes another person's rights; or
  • copy, resell, scrape, reverse engineer or exploit the Service except to the extent such restriction is prohibited by law.

14. Privacy

Our collection, use and disclosure of personal information is described in the SiteVisit Privacy Policy. Organization Customers may also have their own privacy obligations and policies. Site-specific notices may apply when a Visitor enters a particular location.

15. Third-party services

SiteVisit relies on third-party providers for functions such as communications, artificial-intelligence processing, geocoding, email delivery, push delivery, hosting and infrastructure. Third-party services can change, fail or become unavailable. SiteVisit is not responsible for a third-party service outside SiteVisit's reasonable control.

16. Paid features and billing

SiteVisit may offer subscriptions, metered usage, add-ons or other paid features. Any applicable price, included usage, taxes, billing interval and other commercial terms will be shown when the paid feature is enabled or set out in an order form or other written agreement. You will not be charged for a paid feature unless it is affirmatively enabled or otherwise agreed.

SiteVisit may change future pricing or introduce paid features. Changes will apply prospectively and with any notice required by law or an applicable written agreement.

17. Ownership of SiteVisit

SiteVisit and its software, designs, branding, documentation and underlying technology are owned by SiteVisit or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, SiteVisit grants you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose.

If you provide suggestions or feedback, you permit SiteVisit to use them without restriction or compensation.

18. Service changes and availability

SiteVisit is an evolving service. We may add, change, limit or discontinue features, perform maintenance, or modify technical requirements. We do not guarantee uninterrupted or error-free availability unless a separate written service-level agreement expressly says otherwise.

19. Suspension and termination

SiteVisit may restrict or suspend access where reasonably necessary to address security risks, unlawful activity, material violations of these Terms, non-payment of agreed charges, abuse of third-party services, or legal requirements. Organization Customers may stop using the Service and may disable their users or locations through available account controls.

Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability and payment obligations already incurred—will survive.

20. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” SiteVisit disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement and any warranty arising from course of dealing or usage of trade.

SiteVisit does not warrant that check-ins, communications, AI output, GPS verification, welfare prompts, escalations, notifications or third-party delivery will always be accurate, timely, complete or available.

21. Limitation of liability

To the maximum extent permitted by law, SiteVisit will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business, goodwill, data or opportunities, arising from or related to the Service.

To the maximum extent permitted by law, SiteVisit's aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the fees paid to SiteVisit by the applicable Organization Customer for the Service during the 12 months before the event giving rise to the claim, or (b) CAD $100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

22. Indemnity by Organization Customers

To the extent permitted by law, an Organization Customer will defend and indemnify SiteVisit from third-party claims, losses and reasonable costs arising from the Organization Customer's unlawful use of the Service, its site content or instructions, its failure to obtain required authority or consent, or its violation of these Terms, except to the extent caused by SiteVisit's own breach of these Terms or conduct for which liability cannot lawfully be excluded.

23. Changes to these Terms

We may update these Terms as SiteVisit changes or as legal requirements evolve. The current version will be posted here with an updated date. For material changes, we may provide additional notice or request renewed acceptance where appropriate. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.

24. Governing law

These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law rules. Subject to any mandatory legal rights that apply to you, disputes will be brought before the courts of Alberta.
